Terms of Service

1. Acceptance of Terms

By accessing or using SensorCast ("the Service"), operated by NANDBYTE LLC ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, do not use the Service. You must be at least 18 years old to use SensorCast.

2. Service Description

SensorCast is a real-time sensor data streaming platform that enables:

• Collection of sensor data from Android devices
• Real-time streaming of sensor data to subscribers (e.g., ESP32, IoT devices)
• WebSocket-based publish/subscribe architecture

Important: SensorCast does NOT persistently store sensor data. All data is transmitted in real-time and is not retained after delivery.

3. User Accounts

To use certain features of SensorCast, you must create an account:

• Registration: Provide accurate and complete information
• Account Security: You are responsible for maintaining the confidentiality of your credentials
• Username: Usernames must be unique and may not impersonate others
• Responsibility: You are responsible for all activities under your account

Notify us immediately at support@sensorcast.app if you suspect unauthorized access.

4. Acceptable Use

You agree NOT to:

• Use the Service for illegal purposes or in violation of any laws
• Transmit malicious code, viruses, or harmful data
• Attempt to gain unauthorized access to the Service or related systems
• Interfere with or disrupt the Service or servers
• Abuse, harass, or harm other users
• Use the Service to spam or send unsolicited communications
• Reverse engineer, decompile, or disassemble the Service
• Violate the intellectual property rights of NANDBYTE LLC or third parties

Violation of these terms may result in immediate termination of your account.

5. Service Availability

SensorCast is provided on an "as-is" and "as-available" basis:

• Beta Status: The Service is currently in beta and may contain bugs or incomplete features
• No Uptime Guarantees: We do not guarantee uninterrupted or error-free service
• Maintenance: We may perform scheduled or emergency maintenance without notice
• Modifications: We reserve the right to modify, suspend, or discontinue the Service at any time

We are not liable for any downtime, service interruptions, or loss of data.

6. Intellectual Property

Platform Ownership: All rights, title, and interest in the SensorCast platform, including software, design, and trademarks, are owned by NANDBYTE LLC.

User Data: You retain ownership of any sensor data you transmit through the Service. By using SensorCast, you grant us a limited license to transmit and process your data as necessary to provide the Service.

License Grant: We grant you a limited, non-exclusive, non-transferable license to use the Service for personal or commercial purposes, subject to these Terms.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NANDBYTE LLC SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions, downtime, or unavailability
• Errors, bugs, or defects in the Service
• Unauthorized access to or alteration of your transmissions or data

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid to us (if any) in the 12 months preceding the claim.

8. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or completeness

We do not warrant that the Service will be uninterrupted, secure, or error-free. Use the Service at your own risk.

9. Indemnification

You agree to indemnify, defend, and hold harmless NANDBYTE LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your data or content transmitted through the Service

10. Termination

By You: You may terminate your account at any time by contacting us at support@sensorcast.app.

By Us: We may suspend or terminate your account immediately if:

• You violate these Terms
• Your use poses a security or legal risk
• We discontinue the Service

Effect of Termination: Upon termination, your right to use the Service ceases immediately. We may delete your account data, but are not obligated to do so.

11. Modifications to Terms

We reserve the right to modify these Terms at any time:

• We will update the "Effective Date" at the top of this page
• Material changes will be communicated via email or in-app notification
• Your continued use after changes are posted constitutes acceptance

If you do not agree to the modified Terms, you must stop using the Service.

12. Dispute Resolution

Informal Resolution: If a dispute arises, please contact us first at support@sensorcast.app to attempt informal resolution.

Governing Law: These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

Jurisdiction: Any legal action or proceeding arising out of these Terms shall be brought exclusively in the state or federal courts located in Wyoming.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and NANDBYTE LLC regarding the Service and supersede all prior agreements.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
